Refund and Cancellation Policy

1. Acceptance of Policy

By creating an account, starting a free trial, purchasing a subscription, or using tokens in Playlist Pilot, you agree to this Refund and Cancellation Policy. This Policy applies to all users in all locations where payments are processed by Paddle (our merchant of record), subject to any non-waivable rights under applicable law.

2. Definitions

  • "Playlist Pilot" means the web application and related services operated by Alexander Sbragia.
  • "Subscription" means either the Starter Plan or Professional (Pro) Plan that renews on a monthly or annual basis unless canceled.
  • "Tokens" means units that enable use of specific features within a billing cycle. Tokens have no cash value, are not refundable, are not transferable, and expire at the end of the billing cycle.
  • "Paddle" means our payment provider and merchant of record.
  • "Billing Cycle" means the monthly or annual period that begins on your initial charge date or on conversion from a free trial to a paid plan.

3. Nature of Service, No Outcome Guarantee

Important: Playlist Pilot analyzes a user-selected song and suggests playlists that may be a match. Playlist Pilot does not guarantee placements, curator responses, streams, sales, exposure, or any other business result. External platforms and curators are third parties outside our control. Refunds will not be issued due to lack of placements, lack of curator responses, changes in third-party algorithms, removals of playlists, curator conduct, or similar results-based reasons.

4. Plans and Token Use

  • Starter Plan – $9.99/month or $95.90/year, includes 1,000 tokens per billing cycle.
  • Professional Plan – $19.99/month or $191.90/year, includes 2,500 tokens per billing cycle and access to AI Pitch and Pitch Management features.
  • Token consumption:
    • 10 playlist matches for a campaign costs 150 tokens.
    • Each additional set of 10 matches for the same campaign costs 100 tokens.
    • Generating an AI pitch costs 25 tokens.

Tokens are consumed at the moment a feature is used and are not replaced, reissued, or refunded. Unused tokens expire at the end of the billing cycle and do not roll over.

5. Free Trial Terms (Pro Plan only)

  • Length and eligibility: A 3-day free trial is available to new Professional Plan subscribers. One trial per user, payment method, and device.
  • Conversion to paid: At the end of the 3-day trial, your plan converts to a paid Professional Subscription and the first monthly or annual charge is processed automatically unless you cancel before the trial ends.
  • Preauthorization: A temporary authorization may be placed by the payment processor to validate your payment method.
  • Misuse: Creating multiple accounts to obtain repeated trials or masking identity to evade trial limits is a violation and may result in account termination and deletion of data without notice.
  • Tokens used during a trial are provided for evaluation and are not eligible for refund or credit.

6. Recurring Billing and Renewal

Subscriptions renew automatically at the end of each billing cycle until canceled. You authorize Paddle to charge your payment method for the plan price then in effect, plus any applicable taxes.

7. All Sales Final, No Refunds

Important: Except where required by law, all charges for subscriptions are final and non-refundable once access to subscription features is granted. This includes, without limitation, charges for full or partial months, unused tokens, downgrades, and time remaining after cancellation within a billing cycle.

8. Limited Exceptions and Exclusive Remedies

Refunds will only be considered if:

  • Technical failure on our side prevents access to purchased services and the issue cannot be resolved after you report it to our support team and allow a reasonable time for resolution.
  • Duplicate billing error for the same plan and billing cycle.
  • Non-waivable statutory right exists in your jurisdiction.

Where a refund is granted, our exclusive remedy will be either: (i) re-performance of the affected feature, or (ii) a service credit applied to your account. Cash refunds will only be issued where legally required or where re-performance or a credit is not feasible.

9. Request Procedure and Deadlines

To request a refund under Section 8, contact support@playlistpilotapp.com within 7 days of the transaction and include your account email, payment receipt, detailed description of the issue, time stamps, and screenshots or logs. Requests made after 7 days will not be considered unless required by law.

10. Chargebacks and Account Actions

You agree to first contact support and allow a reasonable opportunity to resolve any billing concern before initiating a chargeback. Initiating a chargeback without first contacting support may be treated as misuse. Any account involved in a chargeback may be permanently banned from Playlist Pilot and all associated data deleted. We reserve the right to dispute chargebacks with evidence of your acceptance of this policy and usage logs.

11. Taxes, Price Changes, and Currency

All prices are in USD. Paddle may collect taxes as required by law based on your billing address. Prices are subject to change with notice. Any change will take effect on the next renewal date.

12. Cancellations and Downgrades

You may cancel at any time. Cancellation stops future billing but access will remain active until the end of the current billing cycle. No prorated refunds are issued.

13. Fraud, Abuse, and Fair Use

We may suspend or terminate accounts for fraud, abuse, or policy violations. Termination for cause does not create any right to a refund.

14. Availability and Maintenance

We strive for high availability but do not guarantee uninterrupted service. Scheduled maintenance, emergency maintenance, or outages caused by third-party providers are not grounds for a refund unless required by law.

15. Jurisdiction-specific Disclosures

  • European Union & UK: You may have a statutory right to withdraw from a distance contract within 14 days. By starting a subscription immediately and accessing digital features, you expressly request immediate performance and acknowledge that your withdrawal right is lost once performance begins.
  • United States: This policy complies with applicable federal and Illinois state negative option billing laws.
  • Australia: Your rights under the Australian Consumer Law may apply and cannot be excluded.

16. Paddle as Merchant of Record

Paddle acts as the merchant of record for transactions, handles billing, invoicing, and applicable taxes, and may be the first line of contact for payment confirmations and receipts.

17. Data and Evidence

You consent to our use of server logs, token consumption logs, and event telemetry as evidence of feature access and usage in connection with any refund or chargeback investigation, subject to our Privacy Policy.

18. Changes to this Policy

We may update this policy from time to time. Material changes will take effect on the next renewal and will be communicated in-app or by email. Continued use after the effective date constitutes acceptance.

19. Governing Law and Venue

This policy is governed by the laws of the State of Illinois, United States, without regard to conflicts of law. Exclusive venue lies in the state and federal courts located in Cook County, Illinois, unless your local law requires a different forum.
